The Reasons for Apostille – Why It Is Important.

What is an Apostille?

The really simple answer is that a government authorised authority in countries that are signatories to the Hague convention in apostille checks that a document you submit is true correct and legally issued by the people it says issued it. _ It does not verify that the document is a legal document merely that it is issued by the people who claim to have issued it and that they have the authority to do so.

This means that my birth certificate that was issue six decades ago in Scotland can be submitted. The Apostille authority then checks the document, checks certain details – address of where I was born – good luck with that it is a shopping mall now – and checks the local or national records for confirmation that the place name and date are on record.  This is how it would work in Scotland. They have access to the records etc. They can verify that the details are as they say they are and stamp the Certificate as Authentic.  – even if it is like, like mine a certified copy.

If you are married to an Indonesian National and you have a baby born in Indonesia, by birth that child is entitled to Indonesian Citizenship. However, that is only an entitlement if you go through all the legal rigamarole of Indonesian bureaucracy surrounding the legal registration of any child in this country.

Once you have all of the legal documents issued here in Indonesia you are all set if you want to do things here. However, if you and your partner decide to return to his/her country or have the spousal partners Embassy issued a citizenship document and passport of that country then the Indonesian documents will need an Apostille. This assures the Embassy that the documents are true and correct and may go ahead and issue the requisite documents for the child’s dual citizenship.

Incidentally, Indonesia allows children of mixed marriage to acquire passports and citizenship from both countries until the age of 18. Then they much choose one or the other. Indonesia does not recognise dual nationality for adults.

This is the same for Indonesians or others with any official documents issued in Indonesia. Educational Qualifications and certificates, company registration, property ownership, land titles, any document that may be used in institutions in other countries.

Because Indonesia is a signatory to the Hague convention, the authorised officials that issue the the Apostille are recognised as is the Apostille attached to the documents in all countries that are signatories and most countries that are not.
